Legal Status of CBMPs

Legal Status of CBMPs

Statement on the Legal Status of Cannabis-Based Medical Products (CBMPs)

We would like to clarify the legal status of Cannabis-Based Medical Products (CBMPs) within the United Kingdom.

As of November 2018, CBMPs were rescheduled under the Misuse of Drugs Regulations 2001 from Schedule 1 to Schedule 2, allowing for them to be legally prescribed by specialist medical practitioners. This regulatory change means that cannabis, when prescribed in the form of an authorised CBMP, is legally recognised as a treatment option for certain medical conditions.

It is important to note that:

  • The use of CBMPs is legal when prescribed by a qualified specialist doctor and obtained through a licensed medical provider and pharmacy.
  • Patients who are prescribed CBMPs and use them in accordance with medical guidance are not committing a criminal offence.
  • Possession and use of cannabis outside of a valid medical prescription remains illegal and may result in legal consequences.

Patients should ensure they follow all instructions provided by their prescribing clinician, including dosage, storage, and usage guidelines. This ensures both legal compliance and optimal therapeutic outcomes.

If you are considering medical cannabis treatment, we strongly recommend consulting with a specialist clinician or a registered medical cannabis clinic to explore whether CBMPs may be appropriate for your healthcare needs.

For further information on access and eligibility, you may also refer to guidance provided by the Medicines and Healthcare products Regulatory Agency (MHRA) and the National Institute for Health and Care Excellence (NICE).
